ATIA & POPA - Replacing the FOIP Act
The Access to Information Act, also known as ATIA, and the Protection of Privacy Act, also known as POPA, are Provincial Legislation that applies to all public bodies in Alberta, including the County of St. Paul. The two Acts aim to strike a balance between the public's right to know and an individual's right to privacy, regarding records held by a public body.
ATIA affects a person's right to access records in the custody or control of a public body, while POPA affects the collection, use, disclosure, and safeguarding of personal information by a public body.
The County of St. Paul came under the Provincial Access to Information Act and the Protection of Privacy Act on June 11, 2025.
Access to County of St. Paul Information
Anyone can formally request access to any County of St. Paul record, subject to ATIA and POPA exceptions, so long as those records are not already publicly available through some other means. The County's Access to Information & Protection of Privacy Information Policy includes a list public records, their managing departments, and how these records can be accessed.
If the information in question is not routinely available, you must submit a Formal ATIA Application. Depending on the nature of the request, you may be subject to an initial $25 fee and printing/photocopying costs. If applicable, the ATIA fee of $25 must be paid before work can begin on the request.
Under ATIA legislation, the County of St. Paul has 30 business days, initially, to respond to ATIA requests. This timeframe may be extended in certain circumstances, such as the volume of material to be reviewed or if there is an emergency situation.
Types of ATIA Requests
Personal Information Requests
These requests pertain to personal information about the applicant themselves. Examples can include the applicant's property records or records of employment with the County.
You must provide proof of your identity before records containing your personal information are released to you. If you are requesting personal records on behalf of an individual, you must provide proof that you have authority to act for that person (e.g. guardianship or trusteeship order, power of attorney).
ATIA requests for one's own personal information does not require an initial fee of $25, although there may be charges for photocopying.
General Information Requests
These requests are from an individual or corporate entity looking to access general information contained in records held by a public body. Generally, this is information recorded in any form that has been created by the public body to conduct its programs and services.
Examples of general information requests include an insurance company requesting access to a fire investigation report; a member of the public requesting information about a development permit on a property not owned by them; or an interest group requesting access to information about expenditures.
General information requests require the payment of an initial fee of $25. Applicants will be notified if additional printing and photocopying costs apply.
